1. Eligibility
“Talk 2 Us” Monthly Reward (the “Monthly Reward”) is open only to legal residents of Connecticut, Delaware, North Carolina, South Carolina, Maine, Maryland, Massachusetts, Michigan, New Hampshire, New Jersey, New York, Ohio, Pennsylvania, Vermont, Virginia, and West Virginia who are at least eighteen (18) years old at the time of entry. Proof of residency and age may be required. Employees and directors of Circle K Stores Inc. and the immediate family and household members of such individuals, are not eligible to win. “Immediate family members” shall mean parents, stepparents, children, stepchildren, siblings, step-siblings, or spouses, regardless of where they live. “Household members” shall mean people who share the same residence for at least three months a year, whether related or not.

3. Timing
The Monthly Reward period begins on August 1, 2023, at 12:01 am EST and ends on December 31, 2025, at 11:59 pm EST (“Monthly Reward entry period”).
4. How to Enter
During the Monthly Reward entry period, go to circlekbx.qualtrics.com (“Survey Website”) from your internet-enabled mobile smartphone. You must enter your first and last name, mobile number, and email address on the Survey Website and complete the survey to be eligible for the Monthly Reward. Individuals will receive one entry per store surveyed, per day during the Monthly Reward entry period. Surveys received in duplicate for the same store on the same day will not result in additional entries.
5. Prize
One (1) Circle K gift card in the amount of one hundred dollars ($100) (“Prize”) will be awarded to a single winner during each calendar month of the Monthly Reward entry period. Five (5) total gift cards in the amount of $100 each will be awarded.
6. Winner Selection & Prize Fulfillment
One (1) winner per month will be selected by a random drawing. Drawing will occur within 30 days of the end of each calendar month to determine the winner for the previous month. Limit – one Prize per individual per 12-month period.
Potential winners will be notified via e-mail and text. Potential winners will be notified up to three times, by both e-mail and text each time. First notification will occur immediately after the random drawing. Second notification attempt will occur ten (10) business days thereafter, and third notification attempt will occur after another ten (10) business days. Potential winners failing to respond after three notifications over 30 days will forfeit their Prize. In the event of a potential winner forfeit, no additional potential winner will be selected for that calendar month and no Prize will be awarded.
When a potential winner is reached, potential winner will be asked to provide a photograph of a valid driver’s license in order to verify age and residency. Once verified, the Prize will be shipped to the winner’s attention at the mailing address on the driver’s license.
NOTE: Gift cards ship with a $0 balance for security. Once received, winner will be asked to notify the administrator that the card has arrived. At that time the gift card will be activated and the $100 balance will be available beginning on the following business day.
9. Entry Conditions and Release
Each entrant agrees to: (a) comply with and be bound by these Official Rules and the decisions of Sponsor and Administrator which are binding and final in all matters relating to this Monthly Reward; (b) defend, indemnify, release and hold harmless the Sponsor, Administrator, and their respective parent, subsidiary, and affiliated companies, celebrities, and any other person and organization responsible for sponsoring, fulfilling, administering, advertising or promoting the Monthly Reward, and all of their respective past and present parents, affiliates, officers, directors, employees, agents and representatives (collectively, the “Released Parties”) from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to a participant’s entry, creation of an entry or submission of an entry, participation in the Monthly Reward, acceptance, possession, attendance at, defect in, delivery of, inability to use, use or misuse of Prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry. Winners acknowledge that the Prize is awarded as-is without warranty of any kind.
10. Publicity
Except where prohibited or restricted by law, the winner’s acceptance of the Prize constitutes the winner’s agreement and consent for the Sponsor and any of its designees to use and/or publish the winner’s full name, city and state/province/territory/country of residence, photographs or other likenesses, pictures, portraits, video, voice, testimonials, biographical information (in whole or in part), and/or statements made by winner regarding the Monthly Reward or Sponsor, worldwide and in perpetuity for advertising, publicity, trade and/or promotion on behalf of Sponsor, in any and all forms of media, now known or hereafter devised, including, but not limited to, print, TV, radio, electronic, cable, or World Wide Web, without further limitation, restriction, compensation, notice, review, or approval.
11. General Conditions
Sponsor and its subsidiaries, affiliates, divisions, partners, representatives, agents, successors, assigns, employees, officers and directors shall not have any obligation or responsibility, including any responsibility to award any Prize to entrants, with regard to: (a) entries that contain inaccurate information or do not comply with or violate the Official Rules; (b) entries, Prize claims or notifications that are lost, late, incomplete, illegible, unintelligible, damaged or otherwise not received by the intended recipient, in whole or in part, due to computer, human or technical error of any kind; (c) entrants who have committed fraud or deception in entering or participating in the Monthly Reward or claiming the Prize; (d) telephone, electronic, hardware, software, network, Internet or computer malfunctions, failures or difficulties; (e) any inability of the winner to accept the Prize for any reason; (f) if a Prize cannot be awarded due to delays or interruptions due to Acts of God, natural disasters, terrorism, weather or any other similar event beyond Sponsor’s reasonable control; or (g) any damages, injuries or losses of any kind caused by any Prize or resulting from awarding, acceptance, possession, use, misuse, loss or misdirection of any Prize or resulting from participating in this Monthly Reward or any promotion or Prize related activities. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be (a) tampering with the entry process or the operation of the Monthly Reward or with any Website promoting the Monthly Reward; (b) acting in violation of the Official Rules; or (c) entering or attempting to enter the Monthly Reward multiple times through the use of multiple email addresses. Suppose Sponsor determines, in its sole discretion, that technical difficulties or unforeseen events compromise the integrity or viability of the Monthly Reward. In that case, Sponsor reserves the right to void the entries at issue and/or terminate the relevant portion of the Monthly Reward, including the entire Monthly Reward, and/or modify the Monthly Reward and/or award the Prize from all eligible entries received as of the termination date.
12. Limitations of Liability
The Released Parties are not responsible for: (a) any incorrect or inaccurate information, whether caused by entrants, printing errors, or by any of the equipment or programming associated with or utilized in the Monthly Reward; (b) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (c) unauthorized human intervention in any part of the entry process or the Monthly Reward; (d) technical or human error in the administration of the Monthly Reward or the processing of entries; (e) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Monthly Reward or receipt or use or misuse of any Prize; or (f) for lost, late, illegible, misdirected, inaccurate, incomplete, undelivered, damaged, delayed, entries. If for any reason, an entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, the entrant’s sole remedy is another entry in the Monthly Reward. No more than the stated number of each Prize will be awarded.
13. Disputes
Entrant agrees that: (a) any and all disputes, claims and causes of action arising out of or connected with this Monthly Reward, or any Prizes awarded, shall be resolved individually, without resort to any form of class action; (b) any and all disputes, claims and causes of action arising out of or connected with this Monthly Reward, or any Prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate North Carolina State Court; (c) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Monthly Reward, but in no event attorneys’ fees; and (d) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Monthly Reward, shall be governed by, and construed in accordance with, the laws of the State of North Carolina, without giving effect to any choice of law or conflict of law rules (whether of the State of North Carolina or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of North Carolina.
14. Entrant’s Personal Information
Information collected from entrants is subject to the Sponsor’s Privacy Policy, available at https://www.circlek.com/privacy-policy.
We can collect identifiers and contact information, such as your name, email and postal address, telephone number, Internet Protocol (IP) address, device identifier, device language, or account information. Transactional information, such as the history of purchases made and data generated by your participation in our Monthly Reward program, as applicable (e.g., the number and amount of transactions by type, location/store of purchase, product code information, brand, quantity purchased, date, time, promotional offers used in connection with the transaction. Browsing activity on our websites and apps, such as pages and offers viewed, opt-out preferences, product preferences, click-throughs, content on social media, and IP addresses, if it can identify you as an individual. Geolocation information may be collected when you use our websites and apps, although this information may not always identify you as an individual. We may use your location or language preference to auto-select features when you visit our websites or download our apps. We may use your personal transaction information to provide you with interest-based advertisements on products that we believe may interest you (e.g., products you purchase or redeem frequently). We may collect, combine and categorize your personal information on an aggregated basis to identify purchasing patterns to help us analyze our business to better serve our customers. If you have Monthly Reward account with us, you can update your product preferences in the sidebar menu. Cookies (local file storage) are small text files saved on your device when you visit a website so you can keep that information between visits and campaigns, such as your login credentials, zip, or preferences. For example, cookies allow you to log in quickly when you visit our websites or click on a link in a text message from Circle K We may use all categories of personal information to communicate offers and information we think might interest you, to enhance your customer experience with us, and as otherwise permitted or required by law. We will store your personal information following our retention policies or as otherwise required or permitted by law, after which your personal data will be securely destroyed or anonymized (so the information no longer identifies you). We will save your personal information for up to three months after the campaign ends to enable us to monitor and investigate incidents and manage claims. We may share personal information collected from contest participants with our contest administrator to contact selected winners. The winner may be required to complete and return a 1099-MISC and IRS W-9 form (i.e., Request for Taxpayer Identification Number and Certification). A Prize will only be awarded if the potential winner fully complies with these Official Rules.
