Circle K Coca-Cola® Energy Contest Rules

1. ELIGIBILITY

1.1 To be eligible for the “Coca-Cola® Energy Contest” (the Contest”), an individual must:

A) be a legal resident of the Atlantic Provinces (New Brunswick, Nova Scotia, Prince-Edward-Island, Newfoundland and Labrador) and have reached the age of majority in his/her province of residence at the time of entry.

1.2 Those ineligible to enter the contest are:

A) Employees, representatives and agents of Couche-Tard Inc. (hereafter the Administrator”).

B) Employees, representatives and agents of the Coca-Cola Ltd. (the Sponsor”).

C) Employees, representatives and agents of the Administrator’s advertising, or promotional and media agencies.

D) People involved in the development, production and distribution of materials related to the Contest, and;

E) The immediate family of any of the aforementioned persons, or persons with whom such persons are domiciled. In these Contest rules “immediate family” means husband, wife, spouse, domestic partner, mother, father, brother, sister, son and daughter, whether or not they reside in the same household.

1.3 The Administrator has the right to require, at any time, proof of identity, age and/or eligibility of any participant in the Contest (the Participant”) to allow the Participant to enter the Contest. Failure to provide such proof to the Administrator within seven (7) days of the request could result in disqualification, at the Administrator’s sole discretion.

1.4 All information supplied to the Administrator for the purpose of this Contest must be truthful, accurate and complete.

2. CONTEST PERIOD

2.1 The contest is open on March 30th, 2021 at 00:01AM Atlantic Time and 00:31AM Newfoundland Time and closes on April 26th, 2021 at 11:59PM Atlantic Time and 12:29 AM on April 27th, 2021 Newfoundland Time. (The time between the Contest Opening Date and the Contest Closing Date is the Contest Period”).

3. HOW TO ENTER THE CONTEST

3.1 To enter, purchase two (2) participating Coca-Cola® Energy beverages at Participating Circle K stores in Atlantic Canada during the contest period and remember to save your receipt. Next, go to the official contest website at www.circlek.com/ca/atlantic. Click on the contest page to access the entry form, read and accept these rules, fill in the participant identification section, (with the following personal information: first name, last name, phone number, e-mail address) and enter your pin from the receipt to register and have a chance to win one (1) of ten (10) $100 Circle K gift cards. To enter the contest without purchase, the Participant must send a written entry to the Administrator. All entries must be sent to the following address:

3.2 During the Contest Period, a Participant may submit a maximum of one (1) entry per purchase, or one entry per day without purchase. If a Participant submits more than the entry limit, only the first entry that satisfies the requirements of these rules will be eligible to this Contest. The additional Entries will be considered null and void.

3.3 The Administrator may, at its sole discretion, disqualify any Participant who submitted entries in violation of these rules.

3.4 The sole determinant of time for the purposes of receipt of a valid entry in this Contest will be the Contest server machine(s).

3.5 Use of any automated system to submit an entry is prohibited and will result in disqualification.

3.6 The Participant must enter the Contest in his own name and a proxy cannot be given to this effect, failing which the Participant will be disqualified.

3.7 In the event of a dispute regarding the identity of a Participant, the authorized account holder of the email address submitted at the time of entry will be deemed the Participant. A Selected Participant (as defined below) will need to provide proof that he was the authorized account holder of the email address submitted with the selected entry.

3.8 Entries are subject to verification and will be declared invalid if they are received outside the Contest Period.

4. PRIZE

4.1 Description of Prize – Atlantic Provinces

4.1.1 Prizes provided by Coca-Cola ltd. consists of ten (10) $100 Circle K gift cards. Not redeemable for cash. Approximate Total Retail Value (“ARV” of $1000 CAD). No prize substitution, exchange or transfer of prize by winner. The Sponsor reserve the right, in its sole discretion, to substitute a prize of equal or greater value. (The Prize”) will be awarded at the end of the Contest Period as follow:

4.2 Drawing the Prize

4.2.1 The Prize will be awarded to the Winner as defined below:

4.2.2 The draw will include all valid entries received by the Administrator during Contest Period and be completed on May 3rd, 2021 at Couche-Tard Service Center in Quebec City, Province of Québec (the Draw”).

5. WINNERS SELECTION

5.1 Each Participant who submitted a valid entry during the Contest Period will have a chance to win the Prize.

5.2 Selected Participant for the Prize

5.2.1 Ten (10) Participants will be selected during the Draw among all eligible entries received during the Contest Period as a potential winner of the Prize (the Selected Participant”).

5.2.2 The odds of winning the Prize depend on the number of eligible entries received per Participant during the Contest Period.

5.3 Requirements to be declared winner (the Winner”)

5.3.1 In order to be declared a Winner, the Selected Participant must comply with the conditions set out in the following paragraphs:

5.3.2 The Selected Participant will be notified by email and/or by telephone (if telephone number provided) within ten (10) business days of the Draw.

The Selected Participant must respond to the message within seven (7) business days of the date of the message, failing which, he will be disqualified from the Contest and forfeit the Prize. The Administrator may then select another eligible Participant in accordance with this paragraph 5.3. The new Selected Participant is subject to disqualification if he/she does not comply with these rules.

5.3.3 Before being declared the Winner the Selected Participant must : (i) complete and sign a declaration and release form (the “Declaration and Release Form”) confirming his full consent and compliance with these Contest rules and, as permitted by law, releasing the Administrator and any other organization in association with the Prize, the granting of the Prize or the Contest, together with their respective directors, officers and employees of all responsibility for any injury, accident, loss or misfortune relating to the Contest, Prize or granting of the Prize; (ii) correctly answer, the mathematical skill testing question included in the Declaration and Release Form; (iii) return the signed Declaration and Release Form to the Administrator or as directed on the Declaration and Release Form by the date indicated on the Declaration and Release Form.

5.3.4 In the event that a Selected Participant does not correctly answer the mathematical skill-testing question and/or if the executed Declaration and Release Form is not received by the Administrator before the date indicated on the Declaration and Release Form, the Administrator may, at its sole discretion, select a new Selected Participant by random draw from among the remaining valid entry forms in accordance with these rules. Each new Selected Participant is subject to disqualification if he/she does not comply with these Contest rules.

5.4 The Winner will be notified of the date and place of remittance for the Prize. The Administrator shall have a maximum of one (1) month to remit the Prize after the Selected Participant has been declared the Winner.

5.5 Any incidental expense or other cost not specifically listed in these rules as part of a Prize is solely the responsibility of the Winner. The Administrator is not required to offer any prize other than the Prize described in these rules.

5.6 A Winner is not entitled to the monetary difference between the actual Prize value and the stated approximate value if any.

6. GENERAL CONDITIONS

6.1 The full text of these rules is available at www.circlek.com/ca/atlantic (the Contest Website).

6.2 Except as provided in these Contest rules, no substitution in the Prize is permitted, except at the Administrator sole and entire discretion. If the Prize is not accepted by the Winner, it will be forfeited.

6.3 The Administrator will not be responsible if any event or other factors beyond its reasonable control result in the cancellation of the Contest or prevent the Contest or any part thereof from being fulfilled. Administrator makes no express or implied warranties of any kind with respect to any aspect of the Prize. By accepting the Prize, the Winner acknowledges that there are no warranties applicable to any aspect of the Prize. In no circumstance whatsoever will the Winner have any recourse against Circle K, the Administrator or any other person directly or indirectly involved in this Contest, with respect to any element of any Prize or the Contest.

6.4 Any attempt to damage the Contest Website or any other website related to the Contest, or the legitimate operation of this Contest is a violation of criminal and civil laws. In such cases, the Administrator has the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution.

6.5 There will be no correspondence pertaining to the Contest except with the Winner.

6.6 All entries and Declaration and Release Forms become the property of the Administrator.

7. INDEMNIFICATION BY PARTICIPANT

By entering the Contest and as permitted by law, a Participant:

releases the Administrator and their respective directors, officers, employees, parent companies, subsidiaries, affiliates, suppliers, sponsors and agents from any and all liability for any injury, loss or damage of any kind to the Participant or any other person, including personal injury or property damage, resulting in whole or in part, directly or indirectly, from acceptance, possession, use or misuse of a Prize, participation in this Contest, any breach of these Contest rules, or in any Prize-related activity;

agrees to fully indemnify the Administrator and their respective directors, officers, employees, parent companies, subsidiaries, affiliates, suppliers, sponsors and agents from any and all claims by third parties relating to the Contest, without limitation.

8. CONDUCT

8.1 By entering this Contest, the Participant agrees to be bound by these rules, which are posted on the Contest website throughout the Contest Period.

8.2 The Administrator reserves the right, at its sole discretion, to disqualify any Participant it finds to be:

i) violating these Contest rules;

ii) tampering or attempting to tamper with the entry process or the operation of the Contest Website or any other website related to the Contest;

iii) acting in an unsportsmanlike, unfair or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.

9. LIMITATION OF LIABILITY

9.1 The Administrator assumes no responsibility or liability for lost, delayed, destroyed or misdirected entries, emails or any computer, online, telephone, hardware, software or technical malfunctions that may occur.

9.2 The Administrator is not responsible for any incorrect or inaccurate information, whether caused by any of the equipment or programming associated with or utilized in the Contest or by any technical or human error which may occur in the administration of the Contest.

9.3 As permitted by law, the Administrator reserves the right, to cancel, suspend or modify the Contest, should a virus, bug, computer problem, unauthorized human intervention or other cause beyond the Administrator control, corrupt or affect the administration, security, fairness, integrity or proper conduct of the Contest.

10. RELEASE / PRIVACY / USE OF PARTICIPANT INFORMATION

10.1 By entering this Contest, each Participant consents to use of the personal information he has provided in the course of this Contest by the Administrator for the purposes:

(i) of administering the Contest and awarding the Prize

(ii) to communicate with the Participant about the Administrator products and services or promotional offers.

Subscribing to the Administrator newsletter is optional and will not improve a Participant’s odds of winning the Prize. Please refer to the Circle K’s Privacy Policy at: https://www.couche-tard.com/privacypolicy?lang=en for information on how the Circle K collects, uses, discloses, maintains and keeps personal information secure. Personal information will not be disclosed to third parties, other than as provided for in these rules and/or the Circle K’s Privacy Policy if a Participant subscribes to the Circle K newsletter.

10.2 By accepting the Prize, the Winner consents to the use of his name, photograph, video, likeness, voice, Prize information and/or any biographical information the Winner shares with the Administrator (together, the Winner Information”) for publicity and promotional purpose without further compensation unless prohibited by law in any, all or none of the following: Facebook, Instagram, Circle K Atlantic Newsletter, Circle K Atlantic Website, and any other online or traditional media. The Administrator shall destroy the Winner information within one (1) year following its use thereof.

11. INTELLECTUAL PROPERTY

All intellectual property and all of the promotional materials, web pages and source code are owned by the Administrator, the Sponsor and/or their affiliates. All rights are reserved. Unauthorized use or copy of any copyrighted material or trademarks without the express written consent of its owner is strictly prohibited. Registered trademarks of qualifying products are owned by their manufacturer and their use is unauthorized without the written express consent of the Sponsor.

These are official Contest rules. This Contest is subject to federal, provincial and municipal laws and regulations. The Contest and its rules are void where prohibited. These Contest rules are subject to change, without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the Administrator.

12. POSTING OF WINNERS’ NAMES

Within thirty (30) days of the Draw, the Contest Administrator shall post the Winner’s name on the Contest Website, on its social media and on the newsletter. The Winner’s name shall stay on the Contest Website for a period of at least thirty (30) days.
